Mammoth Computers, LLC Limited Warranty Terms and Conditions

Mammoth Computers, LLC guarantees and warrants that a system built by Mammoth Computers, LLC will be free of defects of any kind in parts and/or workmanship for three years from the date of original purchase. Mammoth Computers, LLC agrees to repair any defect during the first year of purchase with on site service within a reasonable time after the problem is reported. On site service shall be provided solely at the discretion of Mammoth Computers, LLC and will not be used for diagnostic services. After a year has passed from the date of sale, Mammoth Computers, LLC shall at its option repair or replace defective components at its own place of business. Customer shall pay any and all necessary expenses to ensure that the defective parts are delivered to Mammoth Computers, LLC within a reasonable time for repair. Mammoth Computers, LLC agrees to pay the necessary expenses in returning the repaired or replaced component or system to the customer within a reasonable time from the date of repair or replacement.

  • Replacement products will be new or serviceable used parts and are warranted for the remainder of the warranty period or thirty (30) days, whichever is longer.
  • All exchanged parts and hardware products replaced under this warranty become the property of Mammoth Computers, LLC.
  • As to any single claim, if after a reasonable number of good faith attempts by Mammoth Computers, LLC, Mammoth Computers, LLC is unable to restore the hardware product to good working order by repair or replacement, you may request a refund within the warranty period in an amount not to exceed purchase price, excluding any shipping charges, provided that any and all equipment covered under the warranty has been returned to Mammoth Computers, LLC or its agent or mandatary. A request for a refund as it is explained in this paragraph must be in writing and sent to Mammoth Computers, LLC, 705 West Pinhook Rd., Lafayette, LA, 70503 by U.S. Postal Service, Certified Mail Return Receipt Requested and be postmarked no later than Midnight (12:00am) on the final day of warranty coverage. This remedy is the purchaser's exclusive remedy in the event Mammoth Computers, LLC is unable to restore the hardware product to good working order by repair or replacement.

What are the Limitations of your Mammoth Computers, LLC Warranty?

There is no warranty of merchantability or fitness beyond the three (3) year duration of this written warranty. Mammoth Computers, LLC expressly disclaims all warranties not stated in this warranty. There are no warranties which extend beyond the description on the face hereof. Any implied warranties that may be imposed by law are limited to the duration and terms of this warranty:

  • Mammoth Computers, LLC shall not be liable for any damages caused by its products, constructs, or services or the failure of its products, constructs and services to perform, including incidental and consequential damages, including but not limited to lost profits, lost savings, loss of use of the hardware system, lost use of related equipment, cost of substitute or replacement equipment, "down time" or injury to property or persons juridical or otherwise. Under no circumstances shall Mammoth Computers, LLC be liable for incidental, consequential or other damages relating to or caused by software.

When does the Warranty Period Coverage begin?

  • Your sales invoice date is your purchase date for purposes of commencing your warranty period. Your sales invoice is your proof of the date of purchase. The warranty period will not be extended as a result of purchasing additional equipment or services from Mammoth Computers, LLC or upgrading your presently owned Mammoth Computers, LLC products.

What About Software Support?

Technical support for software and applications is provided for thirty (30) days after purchase. Software support will be provided only for Software which comes with your Mammoth Computers, LLC computer and does not include an option for on-site service.

What Your Mammoth Computers, LLC Limited Warranty Does Not Cover

The limited warranty does not warrant or cover:

  • Products purchased without the express approval of Mammoth Computers, LLC or its agents or mandataries;
  • Software, disks and drivers, compact discs, documentation and related information (Please refer to the Publisher's warranty);
  • Damage during shipment other than original shipment to purchaser;
  • Impact with other objects, dropping, falls, spilled liquids, or immersion in liquids;
  • Disaster or Act of God such as fire, wind, flood, earthquake, or lightning;
  • Unauthorized attachments, alterations, modifications, or foreign objects;
  • Peripherals purchased without supervision and express approval of Mammoth Computers, LLC;
  • Problems resulting from adjustments to the purchased hardware and software configuration, and additional hardware and software;
  • Problems caused by configuration conflicts between the Mammoth Computers, LLC - approved system or products operating system and software and hardware from sources other than those expressly approved by Mammoth Computers, LLC;
  • Failure to provide a suitable installation or operational environment for the hardware system (This expressly includes exposing your hardware to cigarette, cigar, pipe, or tobacco smoke of any kind);
  • Use of your hardware system for purposes other than those for which it was designed;
  • Improper maintenance;
  • Any other abuse, misuse, mishandling or misapplication such as use of incorrect voltage, use of incorrect fuses, improper or insufficient ventilation, failure to follow the manufacturer's user manuals which are provided with the system by Mammoth Computers, LLC;
  • Unauthorized repair during the warranty period by a service center or person, juridical or otherwise, other than Mammoth Computers, LLC or events which are beyond the control of Mammoth Computers, LLC.


Thirty Day Money Back Trial

If, for any reason, the customer is not completely satisfied with the hardware or system configuration, any new Computer System built by Mammoth Computers, LLC may be returned for a full refund exclusive of shipping costs and expenses up to thirty (30) days after date of purchase found on the original bill of sale or invoice issued by Mammoth Computers, LLC.

 

Receiving Support for your System:

Technical Support is available by email, and telephone and personal consultation for the entire length of your warranty coverage period. Telephone technical support service is limited to configuration and operation of computer systems designed by and constructed by Mammoth Computers, LLC. Telephone technical support for the operating system and software installed by Mammoth Computers, LLC on the aforesaid computer system shall be provided for a period not to exceed thirty (30) days after the date of purchase found on the original bill of sale or invoice issued by Mammoth Computers, LLC. Mammoth Computers, LLC may dispatch a technician for on-site service or request the system be shipped for repair within the three (3) year warranty period described above if Mammoth Computers, LLC is in good faith unable to repair or restore the hardware product or system configuration to good working order. On-site service will be provided at the sole discretion of Mammoth Computers, LLC and is not considered an option for diagnosing or troubleshooting hardware product or system configuration malfunction.
